   TenantHive is a platform owned and operated by Cimac Digital Solutions (Pty) Ltd ("we," "our," or "us"), designed to connect prospective tenants with landlords and rental agents for rental purposes. By accessing or using TenantHive, you agree to these Terms and Conditions. If you do not agree, please refrain from using the platform.

   These Terms and Conditions, together with our Privacy Policy, define the rights and responsibilities of all users of TenantHive, whether as a tenant, landlord, or landlord's agent ("user" or "you"). TenantHive does not establish any contractual relationship between itself and users regarding lease agreements or tenant placement.

2. Platform Role

   TenantHive functions exclusively as a software platform and intermediary, facilitating information exchange between landlords and prospective tenants. Landlords can list properties, while tenants may submit applications with information such as credit checks, employment status, income, and rental history. TenantHive does not guarantee that tenants will secure a rental property or that landlords will find a suitable tenant.

   Any lease agreement is solely between the tenant and landlord, and TenantHive holds no liability regarding these agreements. TenantHive merely facilitates connections and does not enforce or ensure any specific lease outcomes.

3. User Responsibilities

   Users must be at least 18 years old to use the platform. TenantHive is not responsible for users who misrepresent their age or identity.

   Users must provide accurate, complete, and up-to-date information for rental applications and the selection process. TenantHive does not verify the accuracy of user-provided information, and each party is responsible for verifying others' suitability and reliability.

   Users agree to comply with all applicable laws, including the Protection of Personal Information Act 4 of 2013 (POPIA). By using the platform, users consent to TenantHive's Privacy Policy and the processing of their personal information.

   Users agree not to engage in prohibited actions on the platform, including, but not limited to: providing false information, using the platform for illegal or unlawful activities, or attempting to breach TenantHive's security.

   TenantHive may ban users who engage in fraudulent conduct and report such actions to relevant authorities.

4. Tenant Recommendations

   TenantHive may provide tenant recommendations based on criteria specified by the landlord or property requirements. These recommendations are intended to assist landlords in identifying potential tenants but do not guarantee suitability, reliability, or compatibility. TenantHive makes no warranties, express or implied, about the fitness of any recommended tenant for the landlord's needs.

   Landlords retain full discretion to accept or reject any recommended tenant, and a recommended tenant has no right to demand acceptance based on the recommendation. The final decision to lease rests solely with the landlord, and TenantHive is not liable for the outcomes of any recommendation.

5. Data Security and Retention

   TenantHive will retain user data as long as necessary for transactional purposes or as required by law. While we take reasonable steps to secure user data, users are responsible for protecting their account credentials. TenantHive is not liable for unauthorized access resulting from user negligence.

6. Service Availability

   While TenantHive strives to be permanently available, its service availability may be impacted by factors outside TenantHive's control, such as maintenance or internet outages.

7. Intellectual Property

8. Payment Terms

   TenantHive is free for tenants.

   Landlords are liable for the fees associated with property listings and other services specific to landlords.

   Rental Agents are liable for a base fee in addition to property listing fees.

   All fees payable shall be displayed on TenantHive's website at www.tenanthive.co.za and are subject to change without prior notice.

   Unless otherwise agreed, all fees are due and payable upfront.

9. Limitation of Liability

   TenantHive does not guarantee the accuracy, completeness, or reliability of information on the platform, including property listings, tenant information, or recommendations. TenantHive is not responsible for inaccuracies, errors, or omissions and encourages users to independently verify information before making decisions.

   TenantHive is not liable for any direct, indirect, incidental, or consequential damages, including loss of data, profit, or goodwill, arising from platform use or inability to use TenantHive and disclaims all express or implied warranties regarding the platform's functionality, reliability, and accuracy. TenantHive holds no liability for any contractual or non-contractual relationships between landlords and tenants resulting from platform use.

10. Indemnification

    Users agree to indemnify and hold TenantHive harmless from any claims, damages, or expenses arising from misuse of the platform, breaches of these terms, or disputes related to tenant-landlord agreements.

11. Termination

    Users are free to terminate TenantHive's services at any time by deleting their user profile and requesting us to destroy all information held regarding such a user.

    TenantHive reserves the right to suspend or terminate any user's access if they violate these Terms and Conditions, compromise the platform's integrity, or infringe upon other users' rights. Upon termination, users must immediately cease all platform use.

12. Governing Law and Dispute Resolution

    These Terms and Conditions are governed by the laws of the Republic of South Africa. Any disputes will fall under the exclusive jurisdiction of the South African judiciary.
